The arbitration will take place in Berlin, Germany, and the proceedings shall be conducted in English.
  3. Consumers (Private Individuals): If you are a consumer residing in the European Union, you retain the right to choose between arbitration and litigation in the competent courts under German consumer protection laws. BOS Water will not require arbitration unless mutually agreed after the dispute arises.
  4. Class Action Waiver: Group litigation and collective redress proceedings are excluded to the fullest extent permitted under German law. BOS Water does not participate in dispute resolution procedures before consumer arbitration boards under the VSBG.
  5. Exception for Injunctive Relief: BOS Water reserves the right to seek injunctive or equitable relief in any court of competent jurisdiction in the event of actual or threatened violations of its intellectual property rights or confidentiality obligations. Users acknowledge that violations of BOS Water’s intellectual property or confidentiality may cause irreparable harm for which monetary damages may be inadequate.
  6. Enforceability of Arbitration Clause: If any part of this dispute resolution clause is deemed unenforceable, the remainder shall continue in full force and effect. The parties waive any objections to arbitration based on jurisdiction or venue.
